Lindsay Clancy's defense team is calling for an investigation into the holdout juror who voted to convict her of murdering her three children. The juror, Michael Desronvil, had refused to bow to peer pressure and had asked the judge to dismiss the charges against Clancy.
Desronvil's lawyer, Kevin Reddington, has filed a motion calling for a "limited inquiry" into the holdout juror's background and potential criminal history. However, Clancy's defense team is opposing this motion, arguing that it would undermine the American criminal justice system.
According to Clancy's attorney, Edward Paltzik, Reddington's motion is an attack on the U.S. Constitution and the Sixth Amendment, which guarantees the right to a fair trial. Paltzik warned that if the judge grants the defense demands for an investigation into Desronvil, it could lead to an endless cycle of prosecutors investigating holdouts who oppose a guilty verdict and defense attorneys investigating holdouts who oppose a not guilty verdict.
The case against Clancy, a former labor and delivery nurse, has been marked by controversy. Clancy admitted to killing her children - Cora, 5, Dawson, 3, and Callan, 8 months - but argued that she was not criminally responsible due to postpartum psychosis. Prosecutors argued that she planned the murders and understood that what she was doing was wrong.
Clancy is due back in court on September 29, where a new trial or plea deal is expected to be discussed.
